Terms of Use of Digikliinik
1. Application of Terms of Use
All persons who enter the Digikliinik digital platform and submit information to Digikliinik or otherwise use Digikliinik (hereinafter the user) agree to these terms of use and undertake to comply with them. As the terms of use may be updated from time to time in the manner described in section 9, we recommend that users review the terms of use periodically.
The service should not be used in case of the need for emergency medical assistance, in which case the user should call the number 112 or go to the emergency department.
2. Purpose and Content of Digikliinik
Healthcare services provided through Digikliinik are delivered by Meliva AS (hereinafter Meliva). Digikliinik uses a digital platform operated by BeeHealthy Oy, which provides Meliva with maintenance, data storage, and technical support services for the Digikliinik digital platform.
Digikliinik provides digital doctor clinic services (hereinafter the service). Use of the service creates a customer relationship between the user and Meliva. Digikliinik enables the user to renew prescriptions and to contact and consult at any time with healthcare professionals providing services at Meliva (hereinafter employees) regarding matters related to their health and well-being. Digikliinik provides healthcare services in accordance with the terms for the provision of healthcare services, which are available on the Meliva website.
The user can submit data and ask questions regarding their health and well-being. Data submitted by the user to Digikliinik is transmitted separately to the patient information system managed by Meliva and to the health information system in accordance with applicable legislation.
The user can store and update their personal and contact data as well as refusals and consents in Digikliinik. Certain customer relationship information can be managed on the Digikliinik page “My profile” or in a separate patient information system managed by Meliva.
The user can send a message through Digikliinik to the employee treating them. However, in the case of a message sent in this way, reading of the message is not guaranteed; therefore, if the matter is important or urgent or receipt must be ensured for any other reason, the user must always book an appointment through Meliva or another healthcare provider’s regular appointment service or otherwise ensure proper processing of the information contained in the message. Meliva has the right to direct and restrict the sending of messages only to a specific person.
Digikliinik services may be provided by Meliva employees, private doctors, or Meliva partners. Certain services are paid. Referrals issued in connection with Digikliinik visits for examinations, which the user pays for according to the valid price list, are also considered paid services. As a rule, the service provided by employees consists of resolving one issue at a time. If the visit concerns several different issues, we reserve the right to charge separately for each problem. If it is not possible to resolve your problem in Digikliinik, we will direct you to the appropriate service provider.
The service also includes service and reminder messages sent to the email address and/or mobile phone, for example reminders of booked appointments, notification of completion of test results, or a message from an employee from Digikliinik. The user may prohibit the sending of service or reminder messages, but the user must understand the impact of this, for example on the clarity of Digikliinik services.
Meliva may use Digikliinik and the information contained therein to manage customer relationships related to other health and social services, well-being, and other related services; for managing customer relationships, customer history, feedback, satisfaction data, conducting surveys and studies, quality monitoring, development and analysis; for notifications, marketing and directing services, and for other organization, development, and provision of services.
3. Fees
A fee may be charged for the use of Digikliinik service packages or individual services included therein in accordance with the valid price list available at https://meliva.ee/hinnakiri/eriarst. In addition, the user will be charged for individual healthcare services that may be provided through Digikliinik by an expert working at Meliva, in accordance with the valid price list. If a separate agreement has been concluded regarding notifications, for example in an occupational health contract between the user’s employer and Meliva or a contract between the user’s insurer and Meliva, and the agreement covers the relevant service, the terms of that agreement shall apply. When entering Digikliinik, the user must select the person who undertakes to pay for the services. If the said agreement does not cover the service or the employer or insurer refuses to pay for the services for any other reason, the user must pay for the service themselves.
The fee for services purchased directly from Digikliinik will be charged from the payment method specified by the user, the details of which Meliva transmits to the payment service provider used by Meliva. Meliva is not responsible for issues related to payment transfers; these are the responsibility of each payment service provider. If the payment service provider cannot charge the fee from your specified payment method, we will send invoice details to the email address you provided. If we are unable to charge your specified payment method and we do not receive payment by the due date for the invoice sent to your provided email address, we will initiate debt collection proceedings in accordance with our usual practice.
If the user uses third-party services notified or presented through Digikliinik, the price list and terms of the respective third party apply.
The user is responsible for costs arising from their data communication, software, and hardware.
4. Registration in Digikliinik
To register in Digikliinik and subsequently access the user account, a person needs an Estonian personal identification code and must identify themselves using an ID card, Mobile-ID, or Smart-ID. Upon first entry, the user must agree to these terms of use and provide their email address.
Users who do not have an Estonian personal identification code must contact Meliva for authentication in order to obtain a user account accessible with an email address and password.
Registration and access rights are linked to a specific person; therefore, the user must always use their own personal data and identification data to log into the user account.
5. User Rights and Obligations
The user may use and undertakes to use the services only to support their own health and well-being in accordance with the Digikliinik terms of use, the general terms for the provision of healthcare services, and Meliva’s instructions and guidelines in force at the given time. The services may not be used for commercial purposes.
The user is always responsible for the decision whether to use Digikliinik services or to make a personal visit, treatment, or examination with an employee. Only the user is responsible for deciding on such personal services and, more generally, for the use or non-use of Digikliinik.
The user is responsible for the information submitted and understands that the information provided by the user does not replace information obtained by an employee through personal visits, measurements, or examinations.
The user is responsible for the accuracy and delivery of the data stored and processed by them and for ensuring that only data related to the user’s health and well-being are stored in Digikliinik for the purposes of Digikliinik services. The user must do everything reasonably possible to ensure that the material does not contain malware or is otherwise harmful.
It is important to remember that data submitted or stored by the user in connection with services previously provided via Meliva or Digikliinik may not be accessible or even known to the employee in such form, and must be submitted separately or agreed upon with the treating employee, in which case the user must also ensure that the treating employee has processed the data that the user wished to be processed.
Meliva has the right to verify the correctness of persons’ names, identity, and address from the population register or other known information systems. Personal identification codes are used for verification. However, any checks carried out by Meliva do not change the fact that each person is always responsible for providing correct and sufficient contact details and other necessary personal information.
If the user identifies or suspects incorrect information concerning themselves or others, or that use is contrary to these terms, the user must immediately correct or delete the incorrect information or notify Meliva.
Each user undertakes to keep all non-public information concerning another person and other information obtained through the service confidential and not to use, display, or disclose it, except in accordance with regulations in the interest of the relevant person, with consent, and for the purposes of providing the service.
Each user is responsible for claims made against Meliva, Meliva employees, or private doctors and for any damage caused by the user’s action or inaction.
6. Meliva Rights, Responsibilities, and Limitation of Liability
Digikliinik enables the management of the user’s own health information and other information and notifications to the extent allowed by Meliva at the given time. In addition to remote visit services provided by healthcare professionals, the service may provide, for example, general and personal guidance, which does not replace personal visits, treatment, or examinations by healthcare professionals.
Neither Meliva nor its partners are responsible for the completeness, accuracy, or uninterrupted operation of the service or for the consequences of using or not using the service.
Neither Meliva nor its partners are responsible for the functioning of data communication and communication services between the user and Meliva. Meliva has the right to refuse registration and to restrict, suspend, or remove content from the service at its discretion, for example due to load or other technical reasons or maintenance work, suspected misuse, or connection problems.
Meliva produces and provides the service as it is available. Meliva is not responsible for the costs of the user or third parties or for direct or indirect damage caused to the user or third parties arising from the use or non-use of the service or otherwise. In no situation shall Meliva’s liability exceed that provided for by mandatory Estonian law.
Meliva and its partners are not responsible for delays or other breaches of obligations caused by reasons beyond Meliva’s control, such as strikes and other collective measures, fire, illness, power outages, data communication interruptions or information system failures, actions arising from public law measures, or any other reason that cannot reasonably be expected to be eliminated by Meliva.
All rights to Digikliinik belong to Meliva or are duly licensed to Meliva. The user may not copy, store, reproduce, modify, or transfer Digikliinik. However, the user has the right to store personal information concerning themselves for the purposes of using the services and in accordance with these terms of use.
7. Use of Personal Data
Meliva may store and otherwise process special categories of personal data through Digikliinik. Such information is confidential and may only be processed and used in accordance with these terms of use, applicable legislation, and consents.
By using Digikliinik, the user agrees to the applicable privacy notice available on the Meliva website.
The patient register managed by Meliva is a separate register from the customer register contained in Digikliinik and includes patient information regarding treatment and examinations provided by Meliva and private doctors acting as controllers.
8. Data Security
Digikliinik operates on the internet and can be accessed via secure data communication, for example through a browser on a computer, mobile phone, tablet, or other device. Meliva has the right to provide the service through other technical applications.
The user understands and agrees that network and mobile services may involve risks. The user is responsible for ensuring proper information security of their devices, environment, credentials, and activities.
Login to Digikliinik is performed using ID card, Mobile-ID, Smart-ID, or other provided authentication. The aim is to ensure proper service provision and information security through appropriate technical solutions.
Meliva may make backups while Digikliinik is valid for the user, but does not guarantee copies of all data entries made by the user and is not otherwise responsible for backups in all situations. For these reasons, each user is responsible for any backups they consider necessary in any situation, both during use of the service and especially upon termination of the service.
If the use of Digikliinik is terminated, Meliva deletes all data stored by the user relating to Digikliinik and the user’s Digikliinik profile, but data related to other services (e.g. feedback and service allocation data) remain in Meliva’s customer register, and data in the separate patient register remain there.
The user undertakes to keep login credentials confidential and to immediately notify Meliva customer service if credentials fall into the wrong hands or if the user detects problems related to the service.
Meliva web services use cookies in accordance with applicable privacy notices available on the websites.
9. Amendment of Terms, Establishment of Rules and Guidelines, and Termination of Agreement
The user has the right to stop using Digikliinik at any time by notifying Meliva. The user may notify termination in person by signing a notice at a Meliva clinic or in another manner described by Meliva.
Meliva has the right, at its discretion, to change the content, prices, and terms of the service, establish rules for using the service, and restrict, suspend, or terminate the service. Meliva will attempt to notify of significant changes. Continued use of the service constitutes acceptance of the changes. If the user does not agree, they must immediately stop using the service and notify termination as described above.
Before possible termination, the user will be notified via the service and/or email.
After termination, the user no longer has the right to use the service. Meliva has a reasonable time to close the service and delete stored data to the extent not required by law.
10. Other Terms
These terms and the service are governed by Estonian law. Negotiations are the primary means of resolving disputes. If no satisfactory solution is reached, disputes will be resolved in Harju County Court.
Healthcare services are subject to general terms available on the Meliva website.
